MIRPUR ( AJK): January 27: Azad Jammu & Kashmir Supreme Court Bar Association while strongly condemning the massive violations of human rights, constitutional, political, legal and moral norms by India in Indian Illegally occupied Jammu Kashmir state, said that the situation in IIOJK stands as the most glaring example of this constitutional failure.
Talking to journalists at Kashmir Press Club here on Monday, the AJK SCBA President Javed Najam-ul-Saqib Advocate said that despite the deployment of hundreds of thousands of her occupational military and para military troops, economic incentives and various coercive measures in IIOJK, India has been unable to quell the spirit of freedom among the Kashmiri people. “It is now globally-recognised evidence that the people of Jammu and Kashmir will not, under any circumstances, accept Indian forced and unlawful rule in the disputed occupied state.
Lamenting the continual Indian reign of state terrorism and violence in the Indian Illegally occupied Jammu Kashmir state besides various other Indian states, the AJK SCBA chief stated that it was crystal clear that the constitution of India, which came into effect on January 26, 1950, and is often hailed as one of the world’s finest documents in theory, has today been stripped of its true essence and founding principles in practice. Dr. B.R. Ambedkar, the architect of this Constitution, envisioned it as a guarantor of equality, justice, and fundamental human rights. However, under the policies of “Chanakya Neeti” and the current “Modi Doctrine,” this once-revered document has been reduced to a lifeless instrument.
Saqib underlined that the Scheduled Castes and other marginalized communities, for whom constitutional safeguards were designed to ensure protection and upliftment, now face systematic discrimination and oppression. “The very individuals who were meant to receive justice under this Constitution have been deprived of their basic rights and relegated to the peripheries of society. The principles of equality and justice have been relegated to mere rhetoric, rendering the Constitution an enabler of systemic injustice,”, he added.
Like all previous years, Kashmiris on January 26, observed Republic Day in India, as Black Day, the world over, as a Black Day, Saqib said and added that the legal fraternity of Azad Jammu & Kashmir, in solidarity with their counterparts in IOJK and other legal organizations, reiterated on thus occasion that until the Kashmiri people are granted their inalienable right to self-determination, as recognized by United Nations resolutions, their struggle for freedom will persist.
The Azad Jammu & Kashmir Supreme Court Bar Association President also strongly condemns India’s persistent denial of fundamental human rights to the people of IOJK, its suppression of their freedom, and the atrocities committed against them.
“We call upon the international community to amplify the voices of the Kashmiri people and stand against the oppressive policies of the Indian government in the disputed occupied state”, he added
Javed Najam-ul-Saqib Advocate reaffirmed unwavering support for the people of Indian Illegally occupied Jammu and Kashmir, the legal fraternity of IIOJK, the All Parties Hurriyat Conference, and all international organizations engaged in the peaceful struggle for Kashmir’s right to self-determination.
“The Azad Jammu & Kashmir Supreme Court Bar Association remains steadfast in its commitment to the cause of Kashmir’s freedom and will continue its efforts with courage and resolve”, Javed, Najam-ul-Saqib Advocate concluded.
