MIRPUR ( AJK): August 26: The Supreme Court of Azad Jammu Kashmir here Tuesday took serious notice of the illegal encroachments across Mirpur city including the sites reserved for green belts and parks through their misuse on commercial grounds with the permission of the officials of the Mirpur Municipal Corporation and the Mirpur Development Authority, it was officially stated.
Our Special Jammu Kashmir state Correspondent Altaf Hamid Rao reports from Mirpur that Chief Justice of the apex court Raja Saeed Akram Khan expressed his anger at the Mayor of Mirpur Municipal Corportion Usman Ali Khalid and remarked that why should he not be disqualified from his post for this negligence, carelessness and illegal actions, says an official handout issued here Tuesday.
Mr. Justice Raja Saeed Akram Khan, Chief Justice of Azad Jammu and Kashmir, on Tuesday, August 26, 2025 at the AJK Supreme Court Branch Registry, Mirpur, heard, among other cases, the case titled Robkar Adalat vs. Mayor Municipal Corporation etc., in which Mayor of Mirpur Chaudhry Usman Khalid, Estate Officer of the Municipal Corporation Raja Humayun Razaq, Chaudhry Amjad Iqbal, Director Estate Management Mirpur Development Agency and Mirza Kaleem, Director Administration Mirpur Development Authority appeared before the apex court.
“The court reprimanded the Mayor of Mirpur Municipal Corporation Chaudhry Usman Khalid isduing order to him to immediately submit a detailed report as to under which authority and order of the law, commercial activities were allowed in the green belt and why tuck shops and other commercial activities were allowed on these areas meant for green belts and parks.
“Such actions and activities stand as a blatant violation of the apex court orders”, the learned apex court said. The Mayor of the Municipal Corporation was further ordered to immediately eliminate all illegal, unauthorized and commercial activities and constructions that have been carried out on the green belts and residential areas.
Furthermore, all concerned bodies including the Mirpur Municipal Corportion and the Mirpur Development Authority were ordered to submit a detailed report on whether the total area of View Point Park has been allocated and how much area has been encroached on and how much area has been constructed without permission.
Amjad Iqbal Chaudhry, Director Estate Mananagement Mirpur Development Authority, Mirpur was specifically directed by the learned apex court not to allow the construction of any commercial building or structure in the future.
“In no any case any such activity should not be allowed in the residential areas”, the court ordered categorically.
It was also brought in to the notice of the apex court that residential plots have been illegally converted into commercial plots against the rules and regulations. “Such plots on which construction has already been completed or on which construction work was currently underway should not be affected at this stage, the court ordered. However, commercial construction should not be allowed on the new converted plots even though the allottee has also obtained permission for construction from the authority, the learned court ordered.
In this regard, earlier, the Commissioner Mirpur Division and Deputy Commissioner Mirpur were summoned and reprimanded to immediately remove all illegal constructions and encroachments under their supervision. The case was later adjourned for further proceedings, according to the official handout.
