Women Rights in India are guaranteed by the Constitution of India under various Laws that ensure protection, equality and empowerment. Advocate Ataul Mustafa states that key women rights enshrined in the Constitution of India includes Equality before Law(Article 14), Prohibition of discrimination on ground of sex(Article 15),Equal opportunities in Employment (Article 16), Equal pay for Equal work(Article 39d).

Apart from this there are other laws /statutes which protects the rights of women in India such as Protection of women from Domestic Violence Act,2005.Sexual Harrasment of women at workplace Act,2013 safeguard the rights and interests of women in India.

Advocate Ataul Mustafa further states that Article 51(e) of Indian Constitution makes it a fundamental duty of every citizen to renounce practices derogatory to the dignity of women.

In addition to the above laws there is The Indecent Representation of Women (Prohibition)Act,1986 ,prohibit the Indecent Representation of women in Advertisement, Publications and other forms. There is a specific law for Maternity leave for women under the Maternity Benefit Act,1961 which regulates women’s employment before and after childbirth.

Advocate Ataul Mustafa further states that apart from this laws there are other women rights enshrined in the Constitution of India which mandates the reservation of atleast one-third of the seats for women in Panchayat, Municipalities to promote their participation in local governance.Under the National Legal Services Authority Act, women are entitled for Free Legal Aid. Women has right to maintenance under the Domestic Violence Act,2005 and u/s 144 of BNSS,2023.Also National Commission for Women Act,1990 was established as a statutory body to safeguard and protect the rights and interests of Women in India and also every state of India has State Commission to protect and safeguard the rights and interests of women in India.
